Contract Compliance


Since 2010, LDA has administered the distribution of over 35 million dollars in payments  directly to DBE firms. Also, since 2010, LDA has continuously performed contract, labor compliance and subcontractor monitoring activities including, evaluating for accuracy the prevailing wage rates paid to subcontractors and verifying information from certified payroll records. Weekly reports are compiled and submitted detailing the monitoring of subcontractors and prevailing wage rate verification. In addition to conducting site interviews of all subcontractors, LDA monitors subcontractor work performance on site including any issues that may impact related safety. 


  • Review all sub-contract agreements: LDA staff ensures and reviews all sub-contracting agreements between the Primes and S/DBE subcontractors.
  • Prompt Payment Utilization: Prime contractors are required by State Law to pay subcontractors within 10 days of receiving payment from the Owner. LDA staff is responsible for ensuring prompt payment.
  • Retention: The prime contractor withholds a percentage of the subcontractor's payment until the entire job is completed. The LDA staff representative is responsible for ensuring that all subcontractors are paid their due retention.
  •  Change Orders: For all work that is added to the contract after award, the LDA staff  is responsible for ensuring that DBE & SBE firms are considered for participation where applicable.
  • Site Visits: LDA staff will conduct site visits, to familiarize himself/herself with the project, the progress of construction, to conduct labor compliance interview, and to attend meetings.
  • Prevailing Wage: State Law requires workers on public works contracts to be paid at the prevailing wage.  The LDA staff representative is responsible for ensuring proper payment.
  • Certified Payrolls (CPR): The LDA staff representative must review CPRs to ensure prevailing wage compliance.

DBE Compliance

 Lee L. Davis and Associates (LDA) is typically the first sub consultant brought on the project to manage Small and DBE subcontractors- providing job-site monitoring, federal reporting and compliance administration. With leadership from Lee Davis who has held senior and executive management positions in both the transportation and business sectors and has over 15 years of experience in SBE/DBE  contract utilization on large Infrastructure projects , LDA ensures maximum participation of DBE subcontractors.Through the implementation of its DBE Performance Plan, LDA is responsible for ensuring that the DBE project goal is attained which will result in over 35 million dollars of sub-contracting awards for DBE firms on selected projects.Every major infrastructure project that uses federal funds has a DBE compliance responsibility. LDA is the leader in streamlining that interaction between  the Prime and owner’s  DBE compliance Office, providing on-going status reporting in addition to the required monthly and semi- annual  update reports. 

  • Leading the Prime Team’s implementation of the DBE Performance Plan including ensuring compliance with DBE provisions and governing regulations.
  • We oversee that ongoing outreach efforts are coordinated with the construction planning and activities. Most DBE contract requirements invoice the tracking and reporting of the team’s progress and DBE utilization toward the project’s DBE goal. 
  • We ensure accurate counting of DBE participation toward the goal. We also ensure that all prompt payment issues and concerns are addressed and resolved timely on behalf of our DBE/ SBE partners.  
  • We work with project staff to monitoring the performance of DBE firms on the project and the identification and verification of DBE firms for contracting.
  • Payroll Reporting: Part of the employee wage compliance is a accuracy in payroll calculations and reporting. LDA trains and supports DBE firms regarding the best practices. To report project payroll and respond to project accounting request.
  • Document Control: Primes and subcontractors that need assistance integrating current project reporting systems to share project data with agency PM would use LDA to assist with system integration/document control and recorded keeping on a project basis.

Environmental Compliance

 Since we are a professional service firm, the entire project life cycle is our compliance business. Projects that affect the surrounding environment through either run off, mitigation, waste removal and construction pollution. Have federal and state environmental regulations. LDA specializes in storm-water compliance and field inspection to ensure projects are not having a negative environmental impact. These are the environmental compliance services we have experience.


  • Providing Full Service Stormwater inspections for Construction and Industrial Users.
  • Conducting Stormwater sampling as needed for pH and turbidity testing requirements.
  • Providing documentation of field inspections as required per the California State Waterboard.
  • Field monitoring of Stormwater Pollution Prevention Plan (SWPPP) requirements and installation of Best Management Practices (BMP’s) on site.
  • Reporting environmental compliance related progress and findings.

 Design and implement Contract Compliance controls around staffing, contract budgeting and federal contract regulations.  

Financial Reporting

Assist project managers/and lead team members with providing proactive financial review/analysis and documentation for project review meetings, attends project review meetings/other project meetings as needed. Meets with project managers regularly to review burn rate analysis and recommendations and works with project manager to update cost projections to properly reflect current project status. .

  Provided DBE support for contract required records to support compliance  in preparation for audits and information request. If required by contract, LDA will support internal audits related to records, monitoring, and track all findings to ensure resolution by the business group.
